Tribhuvan Dahiya, J (Oral) This petition has been filed seeking benefit of selection grade to the petitioner for the post of Lecturer w.e.f. 01.01.1996, instead of 01.08.2000 on the basis of earlier decision of this Court passed in CWP No.8082 of 2001, R.K. Verma & others vs. State of Haryana & another, upheld by the Division Bench in LPA No.951 of 2012 (Annexure P-3) vide judgment dated 31.10.2012.

Learned counsel contends that similarly placed employees had earlier approached this Court by filing CWP No.9347 of 2016, Jagat Singh Yadav vs. State of Haryana & others, on the basis of aforesaid decision. The same was allowed, vide order dated 20.02.2017 (Annexure P-9), granting the benefit by restricting the arrears to thirty eight months prior to filing f the writ petition. It is further contended that later some other employees approached this Court by filing CWP No.21693 of 2018 titled Ishwar Singh Pilania & others vs. State of Haryana & another, wherein the respondents AVIN KUMAR 2023.08.10 18:17 I attest to the accuracy and integrity of this order/judgment.t

2023:PHHC:102807 CWP No.17262 of 2023 [2] were directed to consider the decide the legal notice in the light of the aforesaid judgments of this Court. In consideration thereof, the claim stands granted to Ishwar Singh Pilania and others by the respondents. Therefore, prayer has been made to direct the respondents to decide the pending legal notice dated 15.03.2023 (Annexure P-11) by taking a decision in the light of aforesaid judgments of this Court.

Mr. R.S. Budhwar, Additional Advocate General, Haryana, accepts notice and submits that pending legal notice, dated 15.03.2023, shall be decided by respondent No.2 expeditiously.

In view thereof, without commenting upon the merits of the case, the instant petition is disposed of with a direction to the respondent No.2 to decide the pending legal notice issued by the petitioner, dated 15.03.2023, by passing a speaking order in accordance with law in the light of judgments mentioned hereinabove, within a period of six weeks from the date of receiving certified copy of this order.
