CWP-19276-2018 (O&M) DAYA CHAUDHARY, J. (ORAL) Learned counsel for the respondents submit that present petition has become infructuous as the prayer in the present petition was for a direction to demolish the unauthorised construction/structure raised by respondents No.7 to 9. The construction has been demolished in pursuance of directions issued by this Court and the status report has also been filed. They further submit that a liberty has already been given to the petitioner vide order dated 6.4.2018 passed in CWP No.6465 of 2017, to seek recovery of damages before the appropriate forum. Keeping in view the submissions and the prayer made, the present petition is disposed of as having been rendered infructuous as nothing survives in the present petition because not only the unauthorised structure built by respondents No.7 to 9 has been demolished but the status report has also been filed. As far as recovery of damage by the petitioner is concerned, he is at liberty to avail the appropriate remedy, in accordance with law.
