IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.21018 of 2017 Date of decision:15.09.2017 Baljit Singh Nandal

...Petitioner

Versus

State of Haryana and others

...Respondents

Coram:

Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. Parmod Parmar, Advocate, for the petitioner.

***** Rakesh Kumar Jain, J.

The petitioner has prayed for a writ in the nature of mandamus to direct the concerned authorities to take appropriate legal action against respondents no.4 and 5 who, despite facing inquiry and found guilty in the inquiry by respondent no.2, are still holding the administration of the society. I have heard learned counsel for the petitioner and examined the available record.

The inquiry was conducted in two complaints bearing nos.52263 52274, both dated 30.04.2015 and in both the complaints, the Enquiry Committee recommended for vigilance inquiry for investigation. Thereafter, the petitioner made a complaint in the Chief Minister Grievance cell on of the same allegations, in which the matter was submitted to the Principal Secretary, Higher Education, Haryana for approval of proposal to stop the grant-in-aid or to appoint Administrator on the Governing Body. The petitioner has submitted that the grant-in-aid has not been stopped and no further action has been taken in this regard.

CWP No.21018 of 2017 [ 2 ] ***** Insofar the present petition is concerned, the petitioner has not placed on record the latest material for the perusal of this Court and in any case, he should have first approached the Secretary of the Department for redressal of his grievance before seeking a writ in the nature of mandamus by invoking extraordinary jurisdiction of this Court and hence, there is no cause for this Court to interfere in this petition. Dismissed.
