This petition has been filed under Section 528 BNSS (482 Cr.P.C.) for quashing the impugned order dated 11.12.2025 (Annexure P-5) passed by the learned Addl. District & Sessions Judge, Fazilka, vide which the bail order of the petitioner has been cancelled and bail bonds and surety bonds have been forfeited to the State and non-bailable warrants have been issued against the petitioner in FIR No.36 dated 23.10.2023 under section 18 of the Narcotic Drugs Psychotropic Substances Act, 1985 registered at Police Station State Special Operations Cell, Fazilka, District Intelligence Wing (SSOC).

Learned counsel for the petitioner submits that the petitioner is a truck driver by profession and had gone to Bombay in connection with his work on the date fixed. It is further submitted that due to heavy traffic congestion, his truck got stranded on the way and, moreover, his mobile phone was also lost. Consequently, petitioner could not appear before the learned trial Court on the date fixed . Learned counsel for the petitioner further submits that the petitioner is ready and willing to join the proceedings before the Court and prays that the impugned order be set aside. 3.

On the asking of the Court, Mr. Parneet Singh Pandher, A.A.G., Punjab accepts notice on behalf of the respondent-State. 5.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file. 6.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 11.12.2025 (Annexure P-5) passed by the learned Addl. District & Sessions Judge, Fazilka. However, in case the petitioner surrenders before the trial Court within next 07 working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court concerned within a period of five days.

The petition stands disposed of.
