Rival contention of the petitioners and private respondents is that their inter se merit has not been considered while offering appointments against the concerned posts. On the other hand, stand of the State is that petitioners failed to join within the stipulated period given in the appointment letters. As a result appointment was offered to next eligible candidates.

The point of controversy, however, remains whether petitioners were properly notified and were given sufficient time to join at the places where they were sought to be posted. It appears that another opportunity was also granted to the petitioners to join their posting. The issue whether they reported pursuant to same and were entitled to be appointed, also needs to be considered.

Petition is disposed of with the directions to the Chief Secretary to form a Committee comprising three senior officers to take appropriate AJAY KUMAR 2019.01.22 10:17 I attest to the accuracy and authenticity of this document
