H. S. Madaan, J. (Oral) Petitioners - Ram Avtar, working as Lineman, Bijender Singh, working as Assistant Lineman and Yajuvender Singh, working as Assistant Lineman, with Dakshin Haryana Bijli Vitran Nigam, Jind (hereinafter to be referred as 'the DHBVN'), feeling aggrieved by order dated 5.9.2020 (Annexure P-3), vide which benefit of ACP scale granted to them, had been withdrawn, statedly without issuing any show cause notice and opportunity of being heard granted to them, have approached this Court, by way of filing the instant writ petition, seeking issuance of a Writ of certiorari for quashing that order.
Admittedly, the petitioner had not submitted any
CWP No. 19767 of 2021 -2representation expressing their grouse in the matter so as to enable the DHBVN, to think over it and take appropriate action and have rather approached the Court directly without do so. Keeping in view the facts and circumstances of the case, in order to enable the respondents to consider the claim of the petitioners and to avoid unnecessary litigation between the parties, the present writ petition is disposed of directing the respondents, especially, respondent No.
2-Superintending Engineer, OP Circle, Dakshin Haryana Bijli Vitran Nigam, Vidyut Nagar, Hisar, to look into the grievances of the petitioners as detailed in the present writ petition, which alongwith Annexures be treated as representation by the petitioners and consider the same in terms of rules, regulations and instructions on the subject and if some action in the matter is warranted, then the needful be done in accordance with law, within a period of two months from the date of receipt of copy of this order, by passing a speaking order, copy of which be conveyed to the petitioners, as per Registered AD Post.
It is observed that in case after passing of the order in representation, the petitioners still feel dissatisfied, then they may approach the Court again in accordance with law for redressal of their grievances.
