(ORAL) Aggrieved by framing of charges, the petitioner came up before this Court. Counsel for the petitioner submits that FIR qua two similarly placed co-accused was quashed by this Court and despite that charges have been framed against the petitioner. He further submits that in fact this is the case trial Court should considered provision of Section 245 Cr.P.C. He further submits that he would be contended and satisfied in case he be permitted to file comprehensive application before the trial Court at appropriate stage under Section 245 Cr.P.
C and the trial Court should decide the same before proceedings further because it is not a case to put the evidence for answer under Section 313 Cr.P.C in the absence of any incriminating evidence. The prayer being innocuous and the same is allowed. Given above, the present petition is disposed of with liberty aforesaid. In case, any such application is filed, trial Court shall consider the same in accordance with law. All pending miscellaneous applications, if any, stand disposed of.
