In the High Court of Punjab and Haryana, at Chandigarh Civil Writ Petition No. 18459 of 2020 Date of Decision: 23.12.2020 Mahipal ... Petitioner(s)

Versus

State of Haryana and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.

Present:

Mr. Sudhir Rana, Advocate for the petitioner(s).

Mr. Samarth Sagar, Additional Advocate General, Haryana for respondents No. 1 to 4.

Anil Kshetarpal, J.

The elections, for the Gram Panchayat, are due to be held in the month of January/February 2021. The petitioner has filed this writ petition, under Article 226/227 of the Constitution of India, in the nature of mandamus, directing the respondents, to decide complaints dated 07.03.2020 and 29.05.2020, against respondent No.5-Gram Panchayat. The complaints are alleging misappropriation of funds by Raj Pal Singh, Sarpanch. He has not been impleaded as a party-respondent. Still further, once the term of elected representatives of the Gram Panchayat is coming to an end, at this stage, it would not be appropriate for this Court to interfere and issue any directions.. The petitioner, if so advised, may file a fresh writ petition after the elections are over.

With the observations made above, the present writ petition is disposed of.
