The instant writ petition has been filed by the petitioner seeking a writ of mandamus for directing the respondents to consider the candidature of the petitioner from General category to Backward Class category for the post of Clerk.

The case set up by the petitioner in Para 10 of the writ petition is that although the petitioner belongs to Backward Class category, however, inadvertently he filled the category as '101' instead of '104', therefore, he should be considered in the Backward Class category.

In support of his claim, the petitioner had placed reliance upon the judgment dated 05.11.2019 passed by this Court in CWP No.26352 of 2018, titled as "Harjit Kaur vs State of Punjab and others." Learned counsel for the State submits that the said judgment has been set-aside by the Division Bench of this Court vide order dated 05.09.2023, passed in LPA No.510 of 2020, titled as "State of Punjab and another vs Harjit Kaur", and the present case is squarely covered by the said judgment of Division Bench. 5.

In this view of the matter, the present writ petition is dismissed in view of the decision dated 05.09.2023 passed in LPA No.510 of 2020.
