By virtue of instant petition, preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus directing the respondents to grant the benefit of pension to the petitioners in view of judgment rendered by Hon'ble Supreme Court in Civil Appeal No.10013-10014 of 2016 decided on 04.10.2016 titled as "R.C. Gupta & Ors. v. Regional Provident Fund Commissioner Employees Provident Fund Organization & ors. (P-2).

Learned counsel for the petitioners submits that though petitioners moved representation dated 19.04.2017 (P-7) followed by legal notice dated 25.06.2018 (P-8) duly served upon the respondents but till date no conscious decision has been taken. Instant petition is disposed of with a direction to respondent(s) to look into the grievances unfolded by the petitioners in legal notice (P-8) and to take a conscious decision, within a period of four months from the date of receipt of certified copy of this order.

However, if the petitioners still feel aggrieved against any of the order(s) passed by the concerned authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
