By virtue of instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of certiorari quashing impugned action of respondents whereby benefit of 1st ACP has been withdrawn and refixed the pension. And further a writ in the nature of mandamus directing the respondents to grant benefit of 1st ACP from 01.01.1996 and refixed the pension after giving the benefit of ACP scale. 2.
At the very outset of the arguments, learned counsel for the petitioners submits that though petitioners served legal notice dated 14.06.2018 (P-8) upon the respondents but till date no conscious decision has been taken. He further submits that petitioners feel satisfied in case direction is issued to respondent No.3 to decide aforesaid legal notice (P-8), within a stipulated period.

Instant petition is disposed of with a direction to respondent No.3Director, Department of Secondary Education, Haryana, Shiksha Bhawan, Sector 5, Panchkula to look into the grievances unfolded by the petitioners in legal notice (P-8) and to take a conscious decision, within a period of three months from the date of receipt of certified copy of this order. 4.
However, if the petitioners still feels aggrieved against any of the order(s) passed by the concerned authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
