In the present writ petition, the grievance, which is being raised by the petitioner, is that the retiral benefits of the petitioner were not being released by the respondents, though, he had already retired on attaining the age of superannuation on 31.07.2016.

At the very outset, learned counsel for the petitioner submits that during the pendency of the writ petition, the benefits for which the petitioner was entitled have already been released by the respondents, hence, the only claim of the petitioner is for the grant of interest on the delayed release of his retiral benefits. Learned counsel for the petitioner prays that the petitioner be granted liberty to approach the respondents by filing a representation for the grant of interest on the delayed release of the DEEPAK KUMAR BHARDWAJ 2019.11.20 13:25 I attest to the accuracy and integrity of this document

Civil Writ Petition No. 24805 of 2016 pensionary benefits.

Learned counsel for respondent No.4 very fairly states that in case any such representation is filed by the petitioner claiming interest, the same will be considered in accordance with the law coupled with the facts and circumstances of the present case and an appropriate order will be passed within a period of three months of the receipt of the same and in case after decision, it is found that the petitioner is entitled for any benefit, the same will also be released to him within a period of one month thereafter. Keeping in view the statement given by learned counsel for respondent No.4, learned counsel for the petitioner states that petitioner does not wish to press this petition any further. Ordered accordingly.
