AT CHANDIGARH CWP No.2123 of 2017 Date of decision:06.02.2017 Suresh Saggar ... Petitioner Vs.

State of Punjab and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE AMIT RAWAL Present:- Mr. K.S.Dadwal, Advocate, for the petitioner. AMIT RAWAL J. (Oral) Learned counsel for the petitioner submits that he has already filed a suit for mandatory injunction for allotment of plot. However, the subsequent events had occurred, whereby, the case of allotment has been rejected. He further submits that he will be moving an appropriate application for amendment of the plaint in order to avoid the multifariousness of the litigation.

The aforementioned prayer of Mr. Dadwal, is most innocuous, fair and honest. In view of the aforementioned, the writ petition is ordered to be dismissed as withdrawn with the liberty to move an application for amendment of the plaint which shall be decided by the Court below in a most pragmatic and reasonable manner, much less in accordance with law.
