IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH LPA-1551-2026 (O&M) Date of decision: 27.05.2026 KAUSHALYA DEVI ....Appellant

Versus

STATE OF HARYANA AND OTHERS

...Respondents

CORAM: HON'BLE MR. JUSTICE ASHWANI KUMAR MISHRA HON'BLE MR. JUSTICE ROHIT KAPOOR *****

Present:

Mr. Viresh Dahiya, Advocate Mr. Vicky Chauhan, Advocate for the appellant.

Mr. Pankaj Middha, Addl. Advocate General, Haryana. ***** ASHWANI KUMAR MISHRA, J. (Oral) 1.

This appeal assails the judgment of the learned Single Judge whereby the Court has refused to interfere with the order of termination passed against the appellant.

2.

The appellant is an Anganwadi worker. She was expected to visit houses in the specified area and take care of pregnant ladies. It has come on record that one of the pregnant ladies died in the area within her supervision, without any report from the appellant.

3.

The learned Single Judge has taken note of the facts, as per which no satisfactory explanation has been furnished by the appellant with regard to deficiency in services. The only defence taken is that the family members did not inform the appellant that the deceased lady was pregnant. The reply submitted by the appellant to the show cause notice makes an interesting MOHIT GOYAL 2026.05.30 14:48 I attest to the accuracy and integrity of this document

LPA-1551-2026 (O&M) 2 reading, and is reproduced as under:- "During the home visit, I observed her going to the terrace quickly to do her household chores like carrying a wet heavy blanket. Her expression did not indicate that she was pregnant." 4.

The far fetched explanation which has been furnished by the appellant would clearly indicate that there was a major shortcoming in rendering of services expected from the appellant. In such circumstances, the contractual employment has been discontinued pursuant to a show cause notice served upon the appellant.

5.

In that view of the matter, no exception can be taken in the present case. Appeal stands dismissed accordingly.

6.

Pending applications, if any, shall stand disposed of. (ASHWANI KUMAR MISHRA) JUDGE (ROHIT KAPOOR) MAY 27, 2026 JUDGE mohit goyal Whether speaking/reasoned :
