ARVIND SINGH SANGWAN J. (Oral) The petitioner alleges violation of the order dated 08.04.2019 passed by the Chief Judicial Magistrate, Karnal, with regard to conducting the polygraphy test of the petitioner on 01.07.2020 at FSL, Madhuban.

As per the affidavit of the Investigating Officer/SI GRP Ambala Cantt., it is stated that on 01.07.2020, the accused had appeared for polygraphy test. The accused Baldev Singh was accompanied by his brother Hardeep Singh but their counsel did not come present and when the Investigating officer contacted the counsel of the accused, he refused to come on the ground of COVID-19 pandemic. Thereafter, both the accused gave consent that the polygraphy test be done in the absence of their counsel and accordingly, the same was conducted. In view of the above, no willful disobedience is made out. Dismissed.
