Petitioner has questioned Notifications dated 07.07.2011 and 08.07.2012 issued under Sections 4 & 6 of the Land Acquisition Act, 1894 respectively, whereby her residential house with `A-Class' construction alongwith a plot measuring 1900 sq.yds, is said to have been acquired. The matter was heard at length on July 21, 2016 and some suggestions were given for amicable solution of the controversy. In deference thereto the Director, Urban Estates Department, Haryana, Panchkula, has informed the Advocate General, Haryana, vide Memo dated 02.11.2016 as follows:

CWP-258-2015 -2- "In compliance with order dated 21.07.2016 passed by the Hon'ble High Court in the instant writ petition, it is intimated that a report has been obtained from Chief Administrator, HUDA, Panchkula. It was reported by CA, HUDA that it is not feasible to construct the sector road, wherein structure of the petitioner falls, because some other structures also exist around the structure of the petitioner as per tentative layout plan. Hence, it was recommended by CA, HUDA that residential construction of the petitioner may be considered for release. The said recommendation has been approved by the Government on 03.08.2016. As per decision of the Government, residential construction/house of the petitioner alongwith proportionate open space total area measuring 1958 sq.yds falling in khasra no.174//15 of village Jhajjar will be released in her favour as per terms and conditions of the Department."

In view of the decision taken by the State Government to release the residential house of the petitioner alongwith open space measuring approximately 1958 sq.yds falling in Khasra No.174//15 of village Jhajjar, the instant writ petition has been rendered infructuous. Disposed of accordingly.
