Petitioner competed in the General Category for appointment to the post of Junior Draftsman(Civil), against 50 posts advertised in the Department of Punjab Water Supply and Sanitation vide advertisement dated 11.1.2010(P-1). One of the essential qualifications prescribed was Diploma in Civil Engineering (2 years' course). The petitioner possessing three years' course was considered ineligible. Some of the similarly situated candidates filed CWPs in the year 2010 challenging such action which were allowed vide order dated 20.5.2014 passed by a learned Single Judge of this Court. It was held that the candidates possessing the Diploma with three years course were to be considered eligible. Based on the decision dated 20.5.2014 the petitioner filed a representation on 16.9.2016 seeking similar treatment.

Petitioner then filed CWP 9575/2017 which was disposed of vide order dated 5.5.2017 directing the authorities to consider his representation dated 16.9.2016 in accordance with law. Said representation has now been Rajinder Parshad Joshi 2018.01.

CWP 21295/2017 dismissed vide impugned order dated 24.5.2017 (P-11) holding that the claim of the petitioner is time barred.

It is settled law that the persons who have slept over their rights cannot seek similar treatment as others who had pursued their legal remedy before the Courts within time.

After arguing for sometime and having failed to convince the Court, learned counsel seeks permission to withdraw the present petition. Dismissed as withdrawn.
