This first petition has been filed for grant of anticipatory bail to the petitioner in case bearing FIR No.80 dated 09.05.2026 registered under Section 61 of the Punjab Excise Act, 1914 at Police Station Sadar Moga, District Moga.

The present FIR was registered on the statement/complaint of ASI Lakhvir Singh alleging therein that when he, alongwith his colleagues, was on a patrolling duty on private vehicle in search of suspected persons, at about 6.20 p.m., a secret information was received that the petitioner was in the habit of selling liquor after purchasing the same from other States and that he had stored liquor in a room constructed in an open plot (Bara) outside the village. In the event of a raid being conducted, the petitioner could be apprehended with the liquor brought by him from other States. Finding the information to be trustworthy and reliable, the investigation was initiated and a raid was conducted at the room so constructed and 17 boxes MANGAL SINGH 2026.05.27 20:33 I attest to the accuracy and integrity of this document

CRM-M-30529-2026 (O&M) of country made liquor 'Wazir' meant for sale in Chandigarh were recovered.

Learned counsel appearing on behalf of the petitioner contends that there is no immediate connection of the petitioner with the aforesaid room and that the recovery in question should not be linked with the petitioner in the present case.

Learned State counsel contends that the investigation is going on and the link evidence shall also be established. He contends that the petitioner has huge criminal antecedents, and that 9 other cases are pending against him under the Excise Act as well as the Gambling Act. FIR No.27/2006, U/s 410 IPC and U/s 13-A of Gambling Act, PS Sadar Moga.

FIR No. 123/2005, U/s 13-A of the Gambling Act, PS Sadar, Moga."

Having heard the learned counsel for the parties and taking into consideration the history of involvement of the petitioner in similar offences, I am not inclined to extend the concession of anticipatory bail to the petitioner.

The present petition is dismissed.
