NIRMALJIT KAUR, J. (ORAL) Prayer in the present contempt petition is for non-compliance of the order dated 24.10.2019.

As per order dated 24.10.2019, the respondent-Corporation was required to pass a speaking order within three months and, in case, the petitioners found entitled to the payment, the same would be released to them by another three months.

Today, learned counsel for the respondent has pointed out that the respondent-Corporation is facing financial hardships. Although, the calculation qua the amount, to be paid to the petitioners, has been made but some time is required for the payment. It is stated that they shall make the payment within three months from today.

COCP-2384-2020 -2In view of the statement made by learned counsel for the respondent, the present petition is rendered infructuous and the same is dismissed as such.

However, in case the said amount is not paid within three months from today, the petitioners will be at liberty to revive the contempt petition. It is also made clear that if the petitioners are forced to revive the contempt petition, the same shall be revived at the costs of Rs.50,000/-, to be paid by the respondent.
