HARINDER SINGH SIDHU, J The case has been taken up through video conferencing on account of Covid-2019 pandemic.

Prayer is for grant of regular bail in case FIR No.25, dated 11.03.2020, under Sections 302, 148 and 149 of Indian Penal Code, 1860 registered at Police Station, Daba, District Police Commissionrate, Ludhiana.

The FIR was got registered on the statement of one Shukeel Kumar alleging that on 11.03.2020, a fight had broken out among the accused persons namely, Beeru, Jatinder Kumar and Ram Mohan (petitioner) with Kishor Kumar on the other side. The complainant and his brother Deepak Kumar reached the spot and tried to intervene the fight. Deepak Kumar brother of the complainant was attacked by Beeru, as a result of which he died. Jatinder Kumar and the petitioner are alleged to have given fist blows to Deepak Kumar. The petitioner has been in custody since 11.03.2020.

CRM-M-36740 of 2020 #2# Learned State counsel has stated that Challan has been presented. The investigation of the case has been completed. In view of the above and keeping in view the prevalent pandemic Covid-19 and the circumstances detailed hereinabove, there is every likelihood that the trial is not likely to be concluded in the near future, without feeling the necessity to advert to the merits of the case, no useful purpose would be served by keeping the petitioner behind the bars. Accordingly, the instant petition for regular bail is allowed. The petitionerRam Mohan is ordered to be released on regular bail on his furnishing bail bonds/surety bonds preferably surety bond from local resident to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned. The present petition stands disposed of accordingly.
