The petitioner was earlier appointed as Lecturer in Agricultural Engineering Department in Govt. Poly Technic College, Sirsa on 15.12.2003. After applying through proper channel, he was appointed as Assistant Professor in Department of Farm Machinery and Power Engineering at CCS HAU, Hisar on 22.08.2009. He was considered eligible for counting his past service towards old non-contributory pension scheme vide memo dated 8.5.2013 and thereafter he applied for transfer of his GPF balance from the office of Accountant General, Haryana to the office of Controller, CCS HAU.

Respondent No.3 transferred the GPF Balance vide reference dated 24.10.2013 but the interest was paid only upto 21.8.2009.

CWP-25847-2015 -2Learned counsel for the petitioner states that interest on delayed payment of General Provident Fund (GPF) from September 2009 to October 2013 was declined vide order dated 6.7.2015 on the ground that there was no delay on the part of the department regarding transfer of GPF because the petitioner had applied for the same after three years and seven months of his appointment as Assistant Lecturer in CCS HAU, Hisar. He states that in similar circumstances, interest on delayed payment of GPF has been granted to one Mr. Dharamveer. He states that the petitioner has submitted representation(Annexure P-6) to the respondents for grant of interest on the delayed payment of GPF citing the precedent of aforementioned case.

Learned counsel for the petitioner states that at this stage he would be satisfied if a direction is issued to respondent No.4 to take a decision afresh on the claim of the petitioner as mentioned in Annexure P-6 in the light of the precedent of Mr. Dharamveer's case (Annexure P-7).

Without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent No.4 to take a decision on the claim of the petitioner as contained in his representation (Annexure P-6) in accordance with law expeditiously, preferably within a period of three months from the date of receipt of certified copy of this order.
