(Oral) Prayer in this petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner in case FIR No.59 dated 03.06.2019 under Sections 498-A IPC registered at Police Station Khanauri, District Sangrur. Learned counsel for the petitioner submits that during the pendency of the present petition, the matter has been compromised between the parties and accordingly, a compromise deed dated 28.01.2020 has been reduced into writing.

Criminal Misc. No. M-32500 of 2019 -2Learned counsel for the complainant, on instructions from the complainant, who is present in Court, does not dispute the very compromise so entered between the parties.

I have heard learned counsel for the parties. In view of the fact that the matter has amicably been resolved between the parties, the order dated 19.08.2019, whereby arrest of the petitioner was stayed, is made absolute. However, in case the petitioner is required in the case in any manner, a clear 15 days notice be given to him. Photocopy of the compromise dated 28.01.2020, so produced by counsel for the petitioner in Court today, is taken on record. At this stage, Mr. Rameshwar Dass, Assistant has appeared on behalf of the office of Sales Tax Department, DETC, Kaithal and has submitted the financial position of the firm i.e. M/s Assam Timber at Guhla Cheeka, which is also taken on record.
