...Respondents
CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY *****
Present:
Mr. Vipul Jindal, Advocate for the petitioner. Mr. Manipal Singh Atwal, DAG, Punjab.
***** AMAN CHAUDHARY, J. (Oral) 1.
Prayer made in the present petition is for directing the respondents to release the retiral benefits including gratuity, leave encashment, arrears of pension etc.
2.
Learned State counsel refers to para 9 of the written statement dated 28.05.2014 to state that the payments have been released except gratuity as no final decision has been taken in the disciplinary cases pending against the petitioner, in view of which, learned counsel for the petitioner states that he would file a representation, which may be directed to be decided in a time bound manner, to which learned State counsel has no objection. 3.
In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents that in case a representation is filed within 4 weeks, the same be decided within a further period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
