Through the instant petition, challenge is thrown to the impugned order dated 26.11.2019/04.12.2019 (Annexure P-5) passed by the Appellate Authority under the Payment of Gratuity Act, 1972, whereby, interest @ 10% per annum on the amount of gratuity has been granted to respondent No.3.

It is a case where respondent No.3was retired on 19.01.2015, and till his date of retirement, he was not served any charge-sheet, or any order through which any recovery can be effected upon him, by the petitioner from the gratuity amount. Therefore, the Authority has rightly imposed the interest @10% per annum.

Keeping in view the above made submissions, no interference is required in the impugned orders dated 26.11.2019/04.12.2019 (Annexure P-5) passed by the Appellate Authority under the Payment of Gratuity Act, 1972. The present petition is accordingly dismissed. 4.
