(Oral) This order shall dispose two petitions i.e. CRM-M-317822019 and CRM-M-38809 of 2019, as the same have arisen out of common FIR and similar prayer has been made in both the petitions. Prayer in these petitions filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the ASHWANI KUMAR 2019.11.21 18:42 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-31782 & 38809 of 2019 -2petitioners in case FIR No.170 dated 03.07.2019 under Sections 452, 354D, 324, 323, 34 IPC registered at Police Station City Sri Muktsar Sahib, District Muktsar Sahib.

Learned counsel for the petitioners submits that pursuant to orders dated 19.08.2019 and 12.09.2019 passed in respective petitions, the petitioners have joined the investigation.

Learned State counsel, on instructions from ASI Ashok Kumar, does not dispute the fact that the petitioners have joined the investigation and submits that the custody of the petitioners is no more required.

I have heard learned counsel for the parties. Considering the fact that the petitioners have joined investigation and their custody is no more required, both the petitions are allowed and the interim order dated 19.08.2019 passed in CRM-M-317822019 and order dated 12.09.2019 passed in CRM-M-38809-2019 is made absolute.

However, the petitioners shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C.
