JASWANT SINGH, J (ORAL) The petitioner, who retired as Sr. Assistant from the office of Punjab State Social Welfare Board-respondent No.2, by way of filing this writ petition has sought a writ of Certiorari for quashing the impugned action of the respondents whereby a recovery of Rs.45,000/- has been effected from his salary towards excess payment made to one Smt. Bimla Devi, Retd. Supervisor working in the same Department.

As per office report, notice issued to respondent No.5 has not been received back served or otherwise. At the time of hearing, learned counsel appearing for the petitioner has produced a copy of letter/communication dated 07.4.2016 vide which a sum of Rs.45,000/- has been ordered to be released to the petitioner on account of refund of recovery amount thereby rendering the present writ petition as infructuous. Dismissed as having become infructuous.
