[1] Due to COVID-19 situation, the Court is convened through video conference.

[2] The F.I.R. was registered on the basis of complaint received from Investigator of insurance company that fake insurance claims were being applied by some persons by purporting the cause of death of their relatives as road accident whereas the deceased were cancer

-2patients. Karambir Singh (petitioner in CRM-M-41350-2021) and Chudiya Ram (petitioner in CRM-M-41574-2021) is relative and father of deceased-Gurdeep respectively. The allegations against them are that Karambir Singh conspired for changing the cause of death of Gurdeep and Chudiya Ram was nominee in the insurance policy of Gurdeep, he received insurance claim in his account.

[3] Mr. Sanchit Punia, Advocate appearing for Karambir submits that petitioner is not the beneficiary of the insurance claim. He is in custody since 30th June, 2021. It is further submitted that as per case set up, the king pin was Pawan Bhoria and was granted bail by the High Court. It is contended that investigation is complete and challan stands presented.

[4] Mr. Naveen Siwach, Advocate appearing for Chudiya Ram submits that petitioner is in custody since 11th August, 2021. It is further submitted that investigation is complete and challan stands presented. It is contended that the Doctor who conducted the Post Mortem was granted bail by this Court.

[5] Ms. Geeta Sharma, Deputy Advocate General, Haryana opposes the prayer for grant of regular bail and submits that it is a big scam. Petitioner-Chudiya Ram had submitted a claim for compensation under the Motor Vehicles Act, 1988 whereas cause of death of the deceased was cancer.

[6] The issue regarding cause of death of the deceased is debatable. No recovery is to be made. Co-accused Pawan Bhoria was

-3granted bail by this Court. Investigation is complete, conclusion of trial is likely to take time.

[7] Having the conspectus of the cases, the petitioners are granted bail subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned. [8] The petitions are allowed.

[9] Photocopy of this order be placed on the file of connected case.
