This is a petition under Section 482 of the Code of Criminal Procedure, 1973 with a prayer to call the status report with regard to the complaint dated 01.06.2023 (Annexure P-2).

On 30.10.2023 the following order was passed : "Learned State counsel submits that the statusreport could not be filed as the original MLR and copy of Discharge Certificate were taken by the petitioner at the time of discharge from the hospital. The same have not been made available to the Investigating Officer or the CMO. He requests for some time to file the status-report. List on 12.12.2023."

Learned counsel for the State on instructions from ASI Sukhpal Singh has submitted that the petitioner had taken the original MLR and the copy of the Discharge Certificate and the same have not been handed over till date. Learned State counsel further assures the Court that as and when the medical record is handed over, necessary/appropriate action would be taken in accordance with law.

Today, on first call, a request for a pass-over was made on behalf of the learned counsel for the petitioner. On the second call no one has put in appearance on behalf of the petitioner. Even on the previous date of hearing i.e. on 30.10.2023, none had put in appearance on behalf of the petitioner. It appears that the petitioner is not interested in pursuing the present petition. This Court is left with no other option but to dismiss the present petition for non-prosecution.

Dismissed for non-prosecution. Pending applications, if any, also stands disposed off.
