(Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution, seeking a writ in the nature of Mandamus for direction to the Commissioner of Customs, Ludhiana-respondent No.1 to release the bank guarantees of the petitioner firm, during the pendency of the provisional assessment.

Learned counsel for the petitioner states that an application for release of the bank guarantees has been submitted to respondent No.2 on 15.09.2017 (Annexure P-3). He, however, prayed that since it was five days back, therefore, he may be allowed to withdraw the present writ petition at this stage with liberty to the petitioner to pursue the matter before the appropriate authority/Department.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to it, in accordance with law.
