The present petition has been filed under Section 482 Cr.P.C. for issuing direction to the official respondents to constitute a medical board with regard to the injuries received to Deen Mohammad vide MLR No. 449/2022 dated 03.11.2022 at Government Hospital Mandi Khera, District Mewat in case FIR No. 329 dated 04.11.2022 registered under Sections 148, 149, 323, 324, 427, 452 and 506 of the Indian Penal Code, 1860 at Police Station Nagina, District Nuh. 2.

Learned counsel for the petitioner refers to Annexure P-3, MLR of injured Deen Mohammad, and submits that there was no injury, which has been declared dangerous to life, despite that Section 307 IPC has been added in the FIR. A representation regarding constitution of Medical Board for conducting remedical of the said injured has been made but no action has been taken thereon. 3.

On receipt of advance notice, Mr.Dhruv Sihag, AAG, Haryana puts in appearance and submits that as per medical report dated 04.11.2022 of injuredMEHAK HURIA 2023.08.03 17:33 I attest to the accuracy and integrity of this document

 





  Deen Mohammad, issued by Jai Prakash Narayan Apex Trauma Centre, AIIMS, New Delhi, injuries i.e. wound Nos. 1 to 3 were opined grievous and dangerous by the doctors, which attracts the offence under Section 307 IPC. A copy of the said report has been produced in Court. He further submits that there are a large number of accused involved in the case and the investigation is going on. 4.

Having heard the learned counsel for the parties and in view of the above, this Court finds no merit in the present petition and as such, the same is hereby dismissed.
