Ankit (Minor) v. State Of Haryana & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 25983 of 2015 Date of decision: 11.12.2015 Ankit and others ....Petitioner(s)
Versus
State of Haryana and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. R.S. Malik, Advocate, for the petitioners.
G.S.SANDHAWALIA, J. (Oral) The petitioners seeks the action against their expulsion from respondent no. 3-school in October, 2015.
A perusal of the paper book would go on to show that requests have been made for reconsideration of the expulsion orders. Representations have also been filed on behalf of the petitioners for a sympathetic consideration, which have further been forwarded by respondent no. 2 to the Deputy Commissioner, who is now also the Principal of the respondent no. 3-school.
Keeping in view the fact that the said representations are still pending, this Court is of the opinion that, at this stage, it would not be appropriate to call upon respondent no. 3 to file reply. Since the issue pertains to the discipline in the school and it is the case of the petitioners that they have been studying there since long and their academic career would be ruined if such a drastic step is taken in the mid session. Thus, it would be appropriate if the said respondent no. 3 takes a decision on the said representations dated 06.10.2015 and 26.10.2015 (Annexures P-5 and P-10) preferably within a period of two weeks from the date of the receipt of certified copy after hearing the parents of the students concerned and taking into account any undertaking which may be given by them for favourable consideration. In case an adverse order is passed on the said representations, the same be conveyed to the petitioners thereafter. 11.12.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.12.14 14:04 I attest to the accuracy and integrity of this document Chandigarh
