Petitioner has prayed for a writ in the nature of mandamus to direct the respondents to consider petitioner's case as a special case for appointment as Constable. It has been urged before the court that petitioner's family was attacked by terrorists way back on 22.08.1990. Mother of the petitioner grappled with the terrorists and caught one of them alongwith his weapon. She was awarded `20,000/- as bravery award by the Governor of Punjab on the Republic Day of 1991. Thereafter petitioner's name was recommended by Senior Superintendent of Police, Gurdaspur to Director General of Police, Punjab for appointment as Constable in Punjab Police. However, his plea was rejected vide order dated 17.06.2005.
Learned counsel for the petitioner submits that even thereafter case for appointment was again recommended by the next Director General of Police to the State Government. However, no decision has been taken till now on the representation. A copy of the petition was handed-over to Mr. Harsimran Singh Sethi, Addl. A.G. Punjab on the last date of hearing to seek his assistance. He submits that case of the petitioner for appointment as Ajay Kumar 2017.11.
CWP No. 21481 of 2017 Constable was rejected twice. According to him, there is no provision in the law under which petitioner can be appointed as a Constable. Besides, the incident relates to the year 1990 for which bravery award, Annexure P1 was given to mother of the petitioner.
In view of above, I am of the considered view that no case for giving direction to the respondents for appointing petitioner as Constable is made out. Petition is hereby dismissed.
