(Oral) The challenge in this writ petition filed under Articles 226/227 of the Constitution of India, is to the Annexure P-13 (dated 13th September, 2017), vide which the technical bid of the petitioner has been declared to be non-responsive. It was urged that no reasons have been accorded in Annexure P-13 and the petitioner has sent a communication on 14th September, 2017 to the respondents seeking reasons for disqualification of the petitioner, which had not been replied so far.

After hearing learned counsel for the parties, perusing the averments made in the writ petition and without expressing any opinion on the merits of the controversy, we dispose of the writ petition by permitting the petitioner to file a detailed and comprehensive representation before respondent No.3 within a period of three days from today. It is, however, clarified that in case such a representation is filed by the petitioner, the same shall be decided by respondent No.3 within a period of next seven days, after affording an opportunity of hearing to the petitioner and by passing a speaking order, in accordance with law.
