*** P.B.BAJANTHRI, J. (ORAL) On 07.11.2016, the petitioner was directed to ascertain whether any inquiry has been rendered against the respondent-workman for remaining absent or not before termination. Learned counsel for the petitioner fairly submitted th at no inquiry has been rendered before order of termination. Therefore the order of termination as well as award passed by the Labour Court dated 05.11.2012 are hereby set aside. The matter is remanded to the competent authority for taking a fresh decision from the stage of the holding inquiry.

In the meanwhile the respondent is entitled for service benefits including monitory benefits. The monitory benefits shall be calculated and disbursed to the respondent-workman within a period of three months from today.

The petition stands disposed of.
