Petitioners have approached this Court assailing show-cause notice dated 12.05.2026, Annexure P5, issued by the District Town Planner, Rewari, whereby petitioners have been asked to explain erection of boundary wall in village Maheshwari, Tehsil Dharuhera, District Rewari, in contraventions of provisions of Punjab Scheduled Roads and Controller Areas Restrictions of Unregulated Development Act, 1963 (for short - '1963 Act').

Counsel states that a perusal of the show-cause notice shows that an opportunity of hearing is to be given to the petitioners on 18.05.2026, but this notice was never served, rather it was pasted on the boundary wall. He submits that upon coming to know of the show-cause notice, petitioners submitted a reply, Annexure P6, which is not being BRIJ MOHAN BHALLA 2026.05.25 12:40 I attest to the accuracy and authenticity of this order/judgment.

Advance copy of the petition has been served upon State. 4.

On asking of Court, Mr. Deepak Bhardwaj, Addl. A.G.,Haryana has put in appearance on behalf of respondents. Upon instructions from Sh. Mandeep Sihag, DTP Enforcement, Rewari, he states that petitioners shall be provided with an opportunity of hearing on 26.05.2026 at 11:00 a.m. at the address specified in notice, Annexure P5. 5.

In view thereof, it is expected that the competent authority, besides giving an opportunity of hearing to the petitioners, shall also consider the reply, Annexure P6, submitted by them and pass an appropriate order. It is clarified that till the time, the show-cause notice is not finally decided, no coercive action shall be taken. 6.

Writ petition is disposed of.
