Sourabh Malhotra v. State Of Punjab And Another
CWP-15661-2023 - 1 -
IN THE HIGH COURT OF PUNJAB & HARYANA AT
CHANDIGARH CWP-15661-2023 (O & M) Date of decision: 08.04.2025 Sourabh Malhotra ....Petitioner
Versus
State of Punjab and another
...Respondents
CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY Present :
Mr. Bharat Jain, Advocate, for the petitioner.
Mr. Swapan Shorey, DAG, Punjab.
AMAN CHAUDHARY, J. (ORAL) 1.
Prayer made in the present petition is for directing respondents to consider the candidature of the petitioner under the category of 'Persons with Disability' for the examination held on 11.09.2022 for appointment as Inspector, Cooperative Societies. 2.
The undisputed facts are that neither the disability certificate dated 15.11.2018, Annexure P-2, which was stated to be available with the petitioner, being relied upon in the present case was uploaded with the application form nor at the time of issuance of admit card showing him to be in general category objected to by filing any representation. It is only after being unsuccessful upon declaration of final result that a representation is stated to have been made for change of category. PARVEEN KUMAR 2025.04.09 18:11 I attest to the accuracy and integrity of this order/judgment.
CWP-15661-2023 - 2 - 3.
There being a specific clause in the advertisement that no change of category would be permitted and a candidate will be responsible for any mistake by him in that regard, thus, the plea that the computer operator in the Cyber Cafe had wrongly selected the category in the form, is untenable in view of the judgment in Ashu Sharma vs. State of Punjab , 2024 NCPHHC 155149 , to which no further challenge was laid, wherein it was held that t erms and conditions of an advertisement are sacrosanct and no changes in the application form, including the category selected, are permissible once submitted, even if third party filled up the same.
4.
In view of the afore, the present petition being bereft of merits is hereby dismissed.
