Petitioners, who are working as ETT Teachers have filed this petition seeking a writ of mandamus directing the respondents to remove the anomaly between them and Junior ETT Teachers in the Municipal Council,Barnala, which has allegedly occurred due to implementation of the ACP 4 year benefits to the juniors. They have further sought stepping up of their pay at part with the junior teachers.
Notice of motion was issued.
Reply by way of affidavit of Dharampal Singla, DEO (EE) Barnala has been filed stating therein that petitioners were appointed as ETT Teachers by the Department of Rural Development and Panchayat,Punjab during the year 2006. It is further stated that teachers who were earlier under the administrative control of Department of Rural Development and Panchayat as well as Department of Local Bodies,Punjab merged in the Department of School Education during the year 2014 and on this account Rajinder Parshad Joshi 2018.05.25 13:41 I attest to the accuracy and integrity of this document
CWP 198/2018 services of the petitioners were also merged in the Department of School Education during the year 2014 alongwith similarly situated teachers. It is stated that teachers who were appointed during the year 2007, and apparently juniors to the petitioners were drawing more salary as compared to petitioners. This anomaly was created on account of implementation of recommendations of pay commission. However, this anomaly has already been removed vide order dated 19.4.2018 and pay of the petitioners refixed after stepping up their pay equal to the juniors vide order dated 19.4.2018 (Annexure R-1).
In view of the reply filed by the respondents wherein anomaly alleged by the petitioners stands redressed, no further adjudication is required in the matter.
Dismissed.
