Only grievance of the petitioners is that respondents are shifting the land fill/dumping site from Bhagtanwala to Fatahpur. According to them, this is being done against the prevalent rules. Notice of motion.

On asking of court, Mr. V. Ram Swaroop, Additional Advocate General, Punjab accepts notice on behalf of respondent No.1. He seeks to place on record affidavit of Dr. Charanjit Singh, Medical Officer of Health, Municipal Corporation, Amritsar. Same is taken on record as Mark "A". Mr. V. Ram Swaroop has referred to paragraph No. 11 thereof and submits that permission was granted to Municipal Corporation, Amritsar to temporarily use the site at Fatahpur for dumping municipal solid waste till commissioning of Municipal Solid Waste Management Plant at Bhagtanwala. He has also referred to proceedings of the meeting held in this regard on 2.1.2015. Civil Writ Petition No. 26766 of 2014 the plant is commissioned, there will be no need of dumping municipal solid waste at Fatahpur.

In view of statement made by learned State counsel, no further direction from this court is necessary. However, petitioners shall be at liberty to file afresh in case needful is not done within six months from today.
