Learned counsel for the petitioner-Bank states that proposal of the borrowers for 'One time Settlement' has been accepted by the Bank and it has been decided to settle the account on lump sum payment of Rs.80 lacs including Rs.35 lacs already deposited by the borrowers. In this manner, the borrowers would pay the balance amount of Rs.45 lacs by 30.09.2017. The borrowers have already issued a cheque dated 25.09.2017 in the sum of Rs.45 lacs. This would render the writ petition infructuous, at this stage. Ordered accordingly.
