Prayer in the present petition, filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is for grant of regular bail to the petitioner, in case FIR No.0034 dated 18.03.2025, under Sections 21, 29 (Section 21-C added later on) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as - NDPS Act), Sections 25(6), 25(7)(i), 25(8) of Arms Act, 1959 and Sections 109, 221 of Bharatiya Nyaya Sanhita (BNS), 2023, registered at Police Station Jhabal, District Tarn Taran.

Briefly, the case of the prosecution is that on 18.03.2025, on receiving secret information, the police party nabbed three accused persons namely Ajaypal Singh @ Mota, Ronak Singh and Deepak Singh, along with 447 grams of heroin, one 30 bore pistol along with magazine and one live

cartridge. Thereafter, on the basis of disclosure statement made by coaccused Ajaypal Singh @ Mota, the present petitioner i.e. Gurpreet Singh @ Sona was apprehended. After his arrest, he also made disclosure statement and got recovered one country made pistol with two cartridges from his house.

Learned counsel for petitioner has contended that the petitioner has been falsely involved in the present case. He was neither named in the FIR nor present at the spot. There is no material on record to show that the petitioner was involved in the offence committed in the present case. No other criminal case is pending against him. He has further urged that trial of the case is likely to take time. Therefore, the petitioner be granted concession of regular bail.

While issuing notice of motion on 29.05.2025, respondent-State was directed to file Status Report and Custody Certificate, which have been placed on record.

Learned State counsel, while referring to the Status Report, has opposed the bail petition while contending that the petitioner was actively involved in the present crime along with his accomplices. He had also got recovered one country made pistol along with two live cartridges from his house. So, he does not deserve the concession of bail. I have heard the learned counsel for the parties and have also gone through the case file.

As per the record of the case, no recovery of contraband had been effected from the petitioner. The petitioner was nominated as accused on the basis of disclosure statement of co-accused Ajaypal Singh @ Mota and one

country made pistol along with two live cartridges was allegedly recovered from his house, on his own disclosure statement. Learned counsel for the petitioner submitted that co-accused Jatinder Singh @ Chindi had also been granted bail by this Court vide order dated 21.08.2025, passed in CRM-M28498-2025. As per the Custody Certificate dated 25.09.2025, which has been placed on record today in Court, the petitioner has already undergone custody of 06 months. Trial of the case is going on, conclusion whereof is likely to take considerable time. So, no useful purpose would be served by further detaining the petitioner behind the bars. Accordingly, the present petition is allowed and the petitioner is ordered to be admitted on regular bail, on furnishing adequate bail bonds and surety bonds, to the satisfaction of concerned learned Trial Judge/Chief Judicial Magistrate/Duty Magistrate.

However, nothing observed herein above shall be construed to be an expression of opinion on the merits of the case. The observations recorded above are only for the purpose of deciding the present bail petition. Pending application(s), if any, shall stand disposed of along with the present petition.
