The petitioner through the instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to re-issue passport of the petitioner.

As per petitioner, FIR Nos. 186 of 2017 under the Excise Act and 217 of 2020 under Sections 323 and 452 of IPC are pending against the petitioner and FIR No. 338 of 2021 under Sections 3 and 4 of the SC and ST Act has already been cancelled.

Learned State counsel confirms aforesaid factual position. 4.
Learned counsel for Union of India submits that in view of Notification No. 570 dated 25.08.1993, the petitioner is supposed to file an PARAMJIT KAUR SAINI 2023.09.06 16:39 I attest to the accuracy and authenticity of this order/judgment
CWP No.15692 of 2023 -2- 2023:PHHC:117538 application before trial court seeking direction to issue passport and visit abroad.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to approach trial court in terms of the afore-stated Notification. 4.
In the wake of statements of both sides, the present petition is disposed of with liberty to approach trial court in terms of afore-stated Notification. If the petitioner moves an application, trial court is requested to decide the said application in terms of the afore-stated Notification expeditiously.
