Daya Chaudhary, J. (Oral) The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing of notices dated 14.11.2014 (Annexures P-3 and P-4), whereby, the respondents have disconnected the electricity supply and have threatened the petitioners to demolish the construction made by them.
Learned counsel for the petitioners submits that similarly situated persons have filed CWP No.24614 of 2014 tilted as Swaran Kumar and others vs. State of Punjab and others, CWP No.24722 of 2014 titled as Ram Sharnam Ashram vs. The State of Punjab NEETU RANI 2015.03.23 13:12 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.26775 of 2014 and others and CWP No.24979 of 2014 titled as Lakhwinder Singh vs. The State of Punjab and others and the same have been disposed of with a direction to respondent No.2 to afford an opportunity of hearing to the petitioners in pursuance of show cause notice issued to them and thereafter to pass fresh order. Learned counsel for the petitioners also submit that the case of the petitioners is at par with those cases.
Without commenting anything on the merits of the case and keeping in view the limited prayer of the petitioners, the present writ petition is disposed of with a direction to respondent No.2 to afford an opportunity of hearing to the petitioners in pursuance of show cause notice issued to them and to pass fresh order thereafter. It is also directed that till decision, no coercive steps shall be taken against the petitioners till passing of orders. The necessary exercise be completed within one month from the date of receipt of certified copy of the order.
Meanwhile, electricity and water connections, if disconnected, be restored.
Disposed of accordingly.
