Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.0059 dated 17.04.2023 registered under Sections 15 and 25 of the NDPS Act (Section 29 of NDPS Act added later on) at Police Station Dhanaula, District Barnala. 2.

Custody certificate filed by learned State counsel is taken on record, as per which, the petitioner is behind bars for 4 months and 12 days and convicted in one more case.

Learned State counsel submits that in furtherance of disclosure statement, the petitioner got effected recovery of 8 kg. poppy straw, in addition to that which was recovered from co-accused and in all the contraband recovered is 1218 kgs.

Learned counsel for the petitioner prays for withdrawal of the present petition, at this stage.
