By virtue of instant petition preferred under Articles 226/227 of the Constitution of India, petitioner has sought a writ in the nature of mandamus directing the respondents to grant revised pension and other pensionary benefits by counting his daily wage service w.e.f. 08.03.1986 to 31.01.1989, which becomes 2 years, 10 months and 22 days approx., work charge service w.e.f. 22.02.1989 to 18.06.2001, which becomes 12 years 4 months approx (condoning the breaks if any) along-with regular service w.e.f. 19.06.2001 to 30.06.2016, which becomes around 15 years & 12 days approx and total service become 30 years 3 months approx. but he was granted the pension only for 30 half years (15 years), whereas he is entitled for pension for 30 years (60 half years), in view of order passed by this Court in CWP No. 9746 of 2015 titled as Gurpal Singh vs. Punjab State Power Corporation Ltd. & others, decided on SONIKA 2018.08.14 10:42 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.19861 OF 2018 --2-- 15.11.2016 (P-5) and similar matter having CWP No.18088 of 2018, titled as "Darshan Lal v. Punjab State Power Corporation Ltd.", decided on 24.07.2018 (P-6) with further prayer to grant interest @12% per annum on revised pension and other pensionary benefits for which he is entitled. 2.

Learned counsel for the petitioner contends that though a legal notice dated 21.06.2018 (P-7) was served upon the respondents but till date neither any reply to the said legal notice has been received nor any final order has been passed by the respondents. He further contends that he feels satisfied in case a direction is issued to respondents to decide the legal notice dated 21.06.2018 (P-7) in a time bound manner.

In view of above, instant petition is disposed of with a direction to respondents to look into the grievances unfolded by the petitioner in the legal notice dated 21.06.2018 (P-7) and to take a conscious decision by passing a speaking order in view of order passed by this Court in CWP No. 9746 of 2015 titled as Gurpal Singh vs. Punjab State Power Corporation Ltd. & others, decided on 15.11.2016 (P-5), within a period of three months from the date of receipt of a certified copy of this order.

However, if the petitioner still feels aggrieved by any order of the aforesaid authority, he shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
