Admittedly the petitioner has already exhausted his legal remedies. The writ petition against the order of termination was dismissed by the learned Single Bench which was upheld by the Division Bench in LPA No.1435 of 2012 decided on 16.10.2012. The said order has attained finality.

As per the judgement rendered by the Division Bench in case of Sanjay Gulati Vs. State of Haryana, 2002 (2) SCT 331 "even if the principle enunciated was varied, the settled rights of the parties could not be disturbed except by filing proper review application or taking up the judgement of the division bench in appeal before the Hon'ble Apex Court." In the present case, the LPA followed by the petitioner was dismissed on 16.10.2012. He did not challenge the same. It has, therefore, attained finality. Hence, no interference is called for. Dismissed.
