Mr. Kshitij Sharma, Advocate, for the applicant-petitioners. G.S.SANDHAWALIA, J. (Oral) C.M. No. 9372-CWP of 2017 has been filed for directing respondents no. 3 and 4 to relieve the petitioner for joining respondent no. 5 in pursuance to letter dated 20.06.2017 issued by respondent no. 5. A perusal of the Memo of Parties would go on to show that there is no respondent no. 5.

The State has filed a short reply on behalf of respondents no. 1 to 4 to submit that condition no. 10, which is the subject matter of challenge in the appointment letter, has been withdrawn as per Annexure R1. A perusal of the letter dated 23.02.2017 addressed by the Additional Chief Secretary to the Director, Medical Education and Research Department, Haryana would go on to show that the Government has decided to withdraw the condition of serving 5 years or executing a bond of `25,00,000/- in lieu thereof in the appointment letters issued with immediate effect.

In such circumstances, this Court is of the opinion that the present writ petition has become infructuous as that was the relief claimed in the present case. Accordingly, hearing of the main case is pre-poned from 08.11.2017 to today and the same is disposed of as infructuous in view of the above.
