Petitioner filed instant writ petition challenging his transfer in which the following order dated 21.9.2017 was passed:- Contends that the petitioner is going to retire from service on 31.5.2018 and the transfer order is contrary to the terms and conditions of the policy. There is no complaint against the petitioner and no administrative exigency is there. Notice of motion for 7.11.2017.

Meanwhile,operation of impugned order dated 18.9.2017 (Annexure P-1) qua present petitioner shall remain stayed. Upon notice, reply on behalf of respondent no.3 has been filed in Court today which is taken on record.

As per said reply the order transferring the petitioner from Samana to Patran stands cancelled by respondent no.2 vide order dated 16.10.2017(R-3/1).
