Learned counsel for the petitioner contends that during pendency of the petition second cancellation report dated 24.8.2022, has been filed by the State, on which the Magistrate issued notice to the complainant on 6.9.2022. On the next date, i.e., 1.11.2022, the complainant suffered a statement that he did not agree with the report, and the case was adjourned to 20.12.2022, for consideration on cancellation/untraced report. The matter still remains pending before the Magistrate for the same purpose.
In these circumstances, learned counsel for the petitioner states that he does not press this petition, awaiting decision on the cancellation report. Accordingly, the petition stands disposed of leaving it open for the petitioner to challenge the Magistrate's decision before the appropriate Court, on being aggrieved.
