In the present civil writ petition, petitioner is seeking direction to the respondents to release the benefit of higher pay scale to the petitioners in view of judgment dated 13.01.2017. The precise grievance of the petitioners is that they are working on technical posts of Mechanic, Welder etc in Haryana Roadways and their services were regularized in terms of notification dated 01.10.2003. The petitioners were issued regularization letter. They were granted pay scales of Rs.2550-55-260-3200 w.e.f 01.10.2003 and subsequently were put under scale of Rs.5200+2400 (Grade Pay) w.e.f 01.10.2006. Now the petitioners are seeking similar benefit as was granted to the petitioners in CWP No. 26108-2016 and in this regard, a representation dated 14.06.2018 has also been given by the petitioners go grant the scale of Rs.
7440+2400 in parity with Suresh Kumar, similarly situated employee, within the purview of the explanation of the department with respect to CWP No. 26108-2016a and advice of this Court in CWP No. Gaurav Arora 2018.08.
CWP No. 19924 of 2018 20066-2010 i.e to decide the matter on the claim of the employees which has been already decided to avoid unnecessary litigation. In view of the above factual position, the writ petition stands disposed of and direction is given to the respondent-department to consider the case of the petitioners, in view of judgment dated 13.01.2017. The above exercise shall be completed within a period of four months from the date of receipt of certified copy of this order.
