The present petition has been filed under Section 482 of Cr.P.C. seeking quashing of the order dated 07.07.2023 (Annexure P-1) passed by the learned JMIC, Sirsa, whereby the petitioner was declared proclaimed person in case FIR No.18 dated 28.01.2017, registered under Sections 279, 337, 427 of the Indian Penal Code, 1860 (for short 'IPC') at Police Station Sadar Sirsa.

On 26.07.2023, the following order was passed:- "Contends inter-alia that petitioner is ready to bear the costs of Rs.10,000/- for non-appearance before the Court below, but he be granted interim protection.

Notice of motion for 05.09.2023.

Petitioner shall surrender before learned trial Court and upon doing so, he be released on interim bail, in the present case, till the next date of hearing on furnishing adequate bail and surety bonds to the satisfaction of learned trial Court subject to costs of Rs.10,000/-. Costs be deposited with JATIN 2026.02.25 18:31 I attest to the accuracy and integrity of this document

Keeping in view the entirety of the factual milieu of the case in hand; especially the main FIR is settled on the basis of compromise and the petitioner having deposited the costs as imposed vide order dated 26.07.2023, and caused appearance before the learned concerned trial Court and released on interim bail; this Court is of the considered opinion that the petition in hand deserves to be allowed. 4.

Ordered accordingly.

The interim order dated 26.07.2023 is hereby made absolute and the impugned order dated 07.07.2023 (Annexure P-1) passed by the learned JMIC, Sirsa declaring the petitioner as a proclaimed person is hereby quashed.
